来源 中国品种权律师网 发布时间 2010-04-27 查看次数 4110. 根据 中华人民共和国植物新品种保护条例 以下简称 条例 的规定，植物新品种权，抽象的是指完成育种的单位或者个人对其授权品种享有的一定期限的排他的独占权 具体的是指对为商业目的生产或者销售授权品种的繁殖材料，和为商业目的将该授权品种的繁殖材料重复使用于生产另一品种的繁殖材料、有例外的，在一定期限和地域内的独占实施许可权。 依据， UPOV公约 78文本和 条例 以及其他相关法律的规定，植物新品种权的内容可归纳如下。 因而，植物新品种权法律规范，尽管应该设定而没有具体设定，但是，在 条例 第六条的 享有排他的独占权 的表述中，隐含着植物新品种权人对这种植物新繁殖机能的实施权。 条例 第三十三条落实了 UPOV公约 78文本的国家义务，规定品种权被授予后，在自初步审查合格公告之日起至被授予品种权之日止的期间，对未经申请人许可，为商业目的生产或者销售该授权品种的繁殖材料的单位和个人，品种权人享有追偿的权利。 尽管 条例 中并未规定此项权利，但是，按照 企业法 和 科技成果转化法 等法律规定，知识产权和技术成果都是可以作价作为投资的。
