A bagger sleeps in front of a temple.with rooster. 司法, 立法, 執法 三機構. 最近看到一起少年謀殺報導, 少年被定罪, 但少年法典條文 92(1) "未成年不可被判死刑" 和 (2) "交由最高元首發落" 與馬來西亞憲法 "司法, 立法, 執法 三機構 不可互相干擾"相對, 就是執法者不可判處. 法官最後以罪名成立無刑可罰的情況下,讓少年"有罪釋放". 理由是最高元首是執法者, 不可交由最高元首判處, 並說明92(2)條文是違憲的. 法典是立法機構所訂的, 司法機構只能遵從所訂下的刑罰, 法官否決法典是否也是違憲? 更令人可笑的是, 立法辯論程序, 竟然讓違憲條文通過, 大馬國會的專業程度另人可恥. 以上短文資料來自星洲日報 7月26號, 如有違法, 請留言作者刪除.
