If you have one of those projects that were between one and 5 acres and did not require an NPDES permit you may have to resubmit. According to DEP, when all new chapter 102 regulations come effective on November 19, 2010 projects that currently have approval for one to 5 acres but do not have an NPDES permit and have not yet been started will need to get a new permit.
