1 먼저 특허법(실용신안법)에서 정의한 발명(고안)에 해당되어야 합니다. 가 특허법상 발명의 정의. 자연법칙을 이용한 기술 사상의 창작으로 고도한 것. 나 실용신안법상 고안의 정의. 자연법칙을 이용한 기술 사상의 창작. 즉, 특허나 실용신안등록을 받기 위해서는 법에서 정한 발명 또는 고안에 해당하여야 하는데 다음의 조건들을 만족하는 것이어야 합니다. 첫째, 자연법칙을 이용한 것이어야 합니다. 자연법칙을 이용하지 않은 것이거나 자연법칙에 위배되는 것은 발명이나 고안에 해당되지 않아 특허나 실용신안등록을 받을 수 없습니다. 예를 들어 인간의 머리에서 나온 연산법칙, 암호화방법, 영구기관 등은 특허나 실용신안등록을 받을 수 없습니다. 단순한 사업방법, 순수한 정신적 활동의 표현, 게임 경기를 하기 위한 개념, 법칙 또는 방법도 자연법칙을 이용하지 않는 것으로, 발명이나 고안에 해당되지 않기 때문에 특허나 실용신안등록을 받을 수 없습니다. 둘째, 기술사상에 해당되어야 합니다. 셋째, 창작한 것이어야 합니다.
