Colored Demos:: As Hobby Lobby Collides with the End of the Second Reconstruction Through the Fair Housing Act
http://coloreddemos.blogspot.com/2014/10/as-hobby-lobby-collides-with-end-of.html
A blog on law, politics, democracy, culture, race. Friday, October 10, 2014. As Hobby Lobby Collides with the End of the Second Reconstruction Through the Fair Housing Act. A week ago, the Court granted cert in Texas Department of Housing and Community Affairs v. The Inclusive Communities Project, Inc. Put this way, this question takes me to the end of last Term and Hobby Lobby. Should have been an easy case. To be sure, this looked as yet another conservative attack on Obamacare through a lens of re...
Colored Demos:: May 2014
http://coloreddemos.blogspot.com/2014_05_01_archive.html
A blog on law, politics, democracy, culture, race. Tuesday, May 6, 2014. Making Sense of Schuette; or, it might be time to give back the 14th Amendment. In the wake of Grutter v. Bollinger. Michigan voters approved Proposal 2, a measure designed to prohibit the use of race in admission to state universities. It stood to reason that the Roberts Court would uphold this proposal, and so it did, in the recent Schuette v. BAMN. That state universities take race into account during their admissions processes?
Colored Demos:: March 2012
http://coloreddemos.blogspot.com/2012_03_01_archive.html
A blog on law, politics, democracy, culture, race. Saturday, March 24, 2012. Op-Ed on the Constitutionality of the Affordable Care Act. My op-ed in The Palm Beach Post. Arguing that the Affordable Care Act (or "Obamacare" as everyone likes to call it) is constitutional is available here. Elizabeth Price Foley of FIU College of Law wrote a competing op-ed, arguing that the Act is unconstitutional, available here. Subscribe to: Posts (Atom). Race, Federalism, and Voting Rights.
Colored Demos:: January 2012
http://coloreddemos.blogspot.com/2012_01_01_archive.html
A blog on law, politics, democracy, culture, race. Tuesday, January 17, 2012. Ward Connerly Deserves to be Paid More Because he's Black. One reason Mr. Connerly has been a particularly effective advocate is that he is black. Mr. Clegg said there were “few people who can do or would do what he does,” adding that it is hard to set a salary on a job that requires enduring racially charged name-calling from fellow blacks. I'm confused. I thought these folks were supposed to be colorblind?
Colored Demos:: The Court on Gay Marriage
http://coloreddemos.blogspot.com/2014/10/the-court-on-gay-marriage.html
A blog on law, politics, democracy, culture, race. Saturday, October 11, 2014. The Court on Gay Marriage. Last week, the U.S. Supreme Court declined to hear appeals from five states that sought to ban gay marriage. The Court also declined to explain why. This led supporters of gay marriage to hail the Court's non-action. But not everyone agreed that this was a good thing. I also wonder what he might say about the Supreme Court short-circuiting the political process in Shelby County. I wonder. Think of th...

Hard times for workers on Labor Day 2010 | My Daily Take
https://mydailytake.wordpress.com/2010/09/06/hard-times-for-workers-on-labor-day-2010
Hard times for workers on Labor Day 2010. Via Harold Meyerson of the WashingtonPost:. Only a purblind ideologue could miss the pattern here. American employers — more than employers in other nations and more than American employers in earlier downturns — have imposed the costs of the recession and, increasingly, the costs of doing business, on their workers, and kept for themselves damn near all the proceeds from doing business. A union-free America. Growth down a little, employment down a lot. P...Leave...

Making Social Security less generous isn’t the answer. The size of that fix is significant, but not astonishing. Over the next 75 years, the shortfall will be equal to about 0.7 percent of gross domestic product. How much is 0.7 percent of GDP? On September 6, 2010 at 2:49 pm Leave a Comment. Sums up the Political Environment | My Daily Take
https://mydailytake.wordpress.com/2010/08/25/sums-up-the-political-environment
Sums up the Political Environment. The political calculus is stunning. More than $1 trillion for the banks? No problem. But $10 billion for teachers and $16 billion to help the poor get healthcare? What happen to a government for the people by the people? Well too f* *ing bad, you don’t lobby well enough. Maybe someday, LOSER! On August 25, 2010 at 11:26 pm Leave a Comment. Change of Power in Washington. Wow, it has been some time since my last post, which is the cause of many things, of which I will not name. But, something very significant happen last night–election day November 2, 2010. Nor does the average person follow politics or public policy close enough to know about the smaller pieces of legislation passed by President Obama, and the Democrat majority in Congress, which include: Ted Kennedy’s national service legislation. 8220;The revenue loss over the next 75 years just from extending the tax cuts for people making over $250,000 — the top 2 percent of Americans — would be about as large as the entire Social Security shortfall over this period,” write. Welcome to 1938 | My Daily Take
https://mydailytake.wordpress.com/2010/09/06/welcome-to-1938
And just as some of us feared, the inadequacy of the administration’s initial economic plan has landed it and the nation in a political trap. More stimulus is desperately needed, but in the public’s eyes the failure of the initial program to deliver a convincing recovery has discredited government action to create jobs. In short, welcome to 1938. Then came the war. From an economic point of view World War II was, above all, a burst of deficit-financed government spending, on a scale that would never have...

Bilibertaralarians? | My Daily Take
https://mydailytake.wordpress.com/2010/08/26/bilibertaralarians
This woeful record cannot simply be blamed on politicians failing to live up to their conservative principles. Conservatism itself has changed markedly in recent years, forsaking the old fusionist synthesis in favor of a new and altogether unattractive species of populism. The old formulation defined conservatism as the desire to protect traditional values. The intrusion of big government; the new one seeks to promote traditional values. Can a new, progressive fusionism break out of the current rut?

My Many Colored Days
My Many Colored Days. February 5, 2009. We spent last weekend at Cannon Beach with Erik's friend Mike and his family. It was incredibly beautiful there; the sun was shining and it was actually warm (relative to Portland, that is). The kids had a blast playing in the sand and "trying" to stay out of the water (although it's way too tempting, even as cold as it is). I sadly forgot my camera, but luckily Mike remembered his.
