January 26, 2012. Should the Fifth Amendment Cover Your Encrypted Data? This ruling is quite disturbing to say the least. A federal Judge in Colorado has ruled that the 5th amendment does not cover the encrypted data on a computers hard drive. That data is personal data and it should be covered under the Constitution, especially since they are trying to find information that will prove their case against the person.
