第二十八条 任何单位和个人引水、截 蓄 水、排水，不得损害公共利益和他人的合法权益。 第七十二条 有下列行为之一，构成犯罪的，依照刑法的有关规定追究刑事责任 尚不够刑事处罚，且防洪法未作规定的，由县级以上地方人民政府水行政主管部门或者流域管理机构依据职权，责令停止违法行为，采取补救措施，处一万元以上五万元以下的罚款 违反治安管理处罚条例的，由公安机关依法给予治安管理处罚 给他人造成损失的，依法承担赔偿责任. 第七十六条 引水、截 蓄 水、排水，损害公共利益或者他人合法权益的，依法承担民事责任。

先后主持或参与拟订了 水库大坝安全管理条例 、 小型水库安全管理办法 、 水库大坝注册登记办法 、 水库大坝安全鉴定办法 、 水库降等与报废管理办法 试行 ， 病险水库除险加固管理办法 、 水库降等与报废管理办法 试行 、 水库大坝安全管理应急预案编制导则 试行 以及 土石坝安全监测技术规范 SL60-94 、 土石坝安全监测资料整编规程 SL169-96 、 水库大坝安全评价导则 SL258-2000 、 大坝安全监测仪器检验测试规程 、 大坝安全监测仪器安装与管理标准 、 水库降等与报废标准 等法规与技术标准，取得了显著成绩，为推进水库大坝安全管理法规体系建设发挥了重要技术支撑作用。 61656; 组织全国水库大坝定期安全检查、评估、鉴定 参与编制全国病险水库除险加固专项规划及相关管理规定 受水利部委托，负责并牵头组织全国病险水库安全鉴定成果核查，目前，已完成专项规划内3800多座病险水库安全鉴定成果的核查工作 负责病险水库除险加固项目信息管理和汇总以及 病险水库除险加固信息月报系统 的维护。
