Dear Rich: An Intellectual Property Blog: Will TM for Sports Journal Cause Problems?
http://dearrichblog.blogspot.com/2012/03/will-my-name-for-sports-journal-cause.html
Wednesday, March 7, 2012. Will TM for Sports Journal Cause Problems? I realize that I can apply for a trademark ($325.00) and or hire a lawyer, which I am ok with doing one or both, but want to test the waters before leaping. Similar marks and similar services? The less "related" the goods, the less chance for confusion - for example, SHELL as a trademark for flatware. Is not likely to be confused with SHELL as a trademark for liquified petroleum gas. The zone of expansion. The Dear Rich Staff. Sorry, Yo...
Dear Rich: An Intellectual Property Blog: Can I Say "Life is Good" on Zazzle Products?
http://dearrichblog.blogspot.com/2015/06/can-i-say-life-is-good-on-zazzle.html
Wednesday, June 3, 2015. Can I Say "Life is Good" on Zazzle Products? Dear Rich: Could someone register a phrase as a brand name and not let anyone else use that phrase? We don't think they're trying to bluff you. You can freely use "life is good" in a song lyric. Or as the title of your book. Purposes, but you'll run into problems using it for trademark purposes. Dear Rich: An Intellectual Property Blog: What Constitutes "Publication" Under Copyright Law?
http://dearrichblog.blogspot.com/2015/07/what-constitutes-publication-under.html
Wednesday, July 22, 2015. Dear Rich: I wrote an “In Remembrance” booklet when a family member passed away. About 20 copies of the booklet were given to family, friends and neighbors. The booklet didn’t even have my name on it because everyone I gave it to knew I was the author. It was not used for a memorial service and there was no sale or public display involved. Recently, I found out that one of my friends had faxed the booklet to two people he knew, even though I asked him not to. The Dear Rich Staff.
Dear Rich: An Intellectual Property Blog: Can We Upcycle Band T-Shirts?
http://dearrichblog.blogspot.com/2011/11/can-we-upcycle-band-t-shirts.html
Tuesday, November 15, 2011. Can We Upcycle Band T-Shirts? We had to look up the definition of upcycling. Right, you had a question. But it's not so simple. There are some other rules for repurposed items that contain trademarks or infringe on a band's right of publicity. Most likely these won't be an issue but to be on the safe side, you can avoid any impression that the touring band endorses the shirt by advertising the items as Handbags Made from Upcycled Rolling Stones T-Shirts. The Dear Rich Staff.
Dear Rich: An Intellectual Property Blog: Do I Lose All Rights When I Blog?
http://dearrichblog.blogspot.com/2015/07/do-i-lose-all-rights-when-i-blog.html
Wednesday, July 29, 2015. Do I Lose All Rights When I Blog? A click-to-agree contract is legally binding in the U.S. And the fact that you don't receive any payment does not prevent it from being enforceable (as long as the arrangement provides some benefit to you- for example, increased exposure versus obscurity. But, of course, that may be "old school" thinking, ignoring the benefits of your personal brand. Exposure and the temporal quality of sports blogging. The Dear Rich Staff. The Dear Rich Staff.

The underlying effect of the proposed law would be to discourage lawsuits against various industries.
