The Ethics of Training. In the previous post, I wrote about a lawsuit filed by a patient who objected to receiving care from a resident (surgeon-in-training). She claimed that she would not have agreed to the operation if she had known about the increased risks associated with having a resident involved. Must patients be informed about the presence of a resident? Should we tell patients that there is a higher risk of complications if trainees are involved? Would we have to stop operating on Fridays?

Dilemma of the week. Given that laparoscopic cholecystectomy is the standard of care for uncomplicated gallbladder disease because it leads to fewer respiratory impairments and a faster return to activities, is the surgeon justified in only offering an open operation? If his patients all do well with his open operation, does he have to tell them about the laparoscopic approach? Thanks for the comment. What if the standard of care isn't so clear, like for laparoscopic versus open hernia repairs?

Dilemma of the week:. This is a lawsuit that was recently filed in Oregon: Lopez-Lunn v. Kaiser. Lawsuits aren't that unusual, but part of this one is notable. In the complaint, the plaintiff states that she was "never informed of the increased risks associated with having a resident surgeon perform surgical procedures" and that she would not have consented to the procedure if she had known those risks. Dilemma of the week: end-of-life care. What was the right thing to do? This is a tough one. I think you'd want to find out more about how much younger they were when they made the living wills. I mean if they made the wills recently, say in the last 10 years, then I don't think her claim that "we couldn't know what would want" does not hold up. Also who is the final arbiter of whether a health care proxy overrides a living will, and could this be considered illegal? I guess depending on the state?
