虽然行政诉讼法没有直接规定行政公益诉讼制度，但该法第101条通过“转致”的方式，授权“人民法院审理行政案件，关于期间、送达、财产保全、开庭审理、调解、中止诉讼、终结诉讼、简易程序、执行等，以及人民检察院对行政案件受理、审理、裁判、执行的监督，本法没有规定的，适用 中华人民共和国民事诉讼法 的相关规定”。 具有原告资格的主体共有三类:第一类是与被诉行政行为在法律上有利害关系的群体所委托的代表人，类似美国以“私人检察总长”的名义提起诉讼的普通公民;第二类是检察机关，类似德国联邦行政法院法规定的“公益代表人” 第三类是符合民事诉讼法规定的法律授权的社会组织(如消费者协会、环保组织等)，考虑到对公共利益的代表能力、法院承受能力等因素，可以授权其在检察机关拒绝起诉的案件中，补充充当公共利益代表人，性质上属于“推定的法律授权”。 同时，与普通行政诉讼中的“不停止执行原则”相反，行政公益诉讼适用“停止执行原则”，一旦检察机关起诉，应立即停止行政行为的执行。 2014中国慈善名人榜 放榜 30位名人入榜 崔永元荣登榜首. 我的梦 中国梦 心教育 全国百所高校公益行启动.
