The USPTO has suggested amending any claim that is drawn to a computer readable media that covers both transitory and non-transitory embodiments may be amended to narrow the claim to cover only statutory embodiments to avoid a rejection under 35 USC § 101 by adding the limitation “non transitory” to the claim. That shows US Patent Data at a glance in a downloadable dashboard format. The dashboard shows a First Office Action Pendency for August 2010 of 26.2 months and a total pendency of 35.4 months.
