Leave a comment ». 2010年3月25日，在Law School的憲法期末考前半個月，針對美國健保法案被數州提起違憲訴訟這個事件，我認為這個法案中，聯邦政府侵犯到了各州所擁有的權力，而寫了 美國健保法案 一文來解釋如何判斷權力歸屬。 值得欣慰的是，從這個National Federation of Independent Business v. Sebelius的判決書可得知，Roberts、Scalia、Alito、Thomas以及Kennedy等五位保守派大法官確實主張聯邦政府沒有權力要求各州居民購買健保，國會所擁有的Commerce Power並無涉及健保法案內容中所規範的領域，因此單以這個角度而言，多數意見主張憲法並沒有授予國會權力來通過這個法案。 然而，造成局勢扭轉的關鍵點卻是在於這個法案有規定 不加入健保，就會罰錢 ，因此它算不算一種稅收 如果可以將它認為是一種稅收，那就可以繞過Commerce Power的問題，而確認這是憲法賦予國會的權力，因為稅收是美國憲法中白紙黑字的國會權力之一。 2012 年 06 月 30 日 於 8:11 下午. Parker一案中曾建立起一個相當重要的標準，在此案中，政府徵收了一個非常破爛的區域，然就將它 轉售 給願意出資重建社區、消除原有不安全、不衛生的私人企業。 然而，這個標準卻在2005年受到了空前的衝擊，那就是政府是否可以透過經濟發展為理由徵收私人住宅，然後 轉讓 給私人企業 聯邦最高法院在赫赫有名的Kelo v. City of New London一案中的回答是 Yes ，結果引發了非常強烈的異議與反彈浪潮。 這件案子的大略背景故事是 New London地區經濟不景氣，於是市政府搞了一個開發計畫，要開發某塊區域來蓋飯店和高級住宅區，認為可以創造就業和增加稅收，但是在市政府搞到大部分的土地後，剩下九個釘子戶不願意被徵收 當然是有補償的 ，於是以Kelo為首的釘子戶就告上法院，主張這不是為了興建鐵路或是消除公害等公共用途，再說他們的居住狀況也很良好，政府不能取走他們的財產供另一個私人來使用。 Is it a taking?
