著作権法を所管する文化庁では、 ダウンロード違法化 として、 違法に複製された著作物を複製するのは、それがたとえ私的複製の範囲内だとしても違法とする というように、法を改正する方針を示しています。 今回の法改正では、そのうち、コピー元が 違法な複製 であるもの、つまり、許可を得ないで作られた海賊版や、無許可でネット上にアップロードされた動画などを、それが違法だと知っていながらコピーしたときには、たとえ個人で楽しむ分だったとしても 私的な複製 とは認められず、違法とする、というものです。 仮に ダウンロード違法化 が逮捕 起訴されうる罰則付きのものになったとしたら、ある人を逮捕する口実として、実に都合のいいものになってしまいます。 また、現在では罰則のない行為をした人について、警察で 何か逮捕できる理由はないか と検討した結果、著作権法違反の容疑で逮捕 起訴したという事例が過去には存在します。
