When VAT should be claimed in a bill. Posted on Jun 23rd 2015. VAT should only be claimed in cases where the receiving party, whether the Claimant or Defendant, is not VAT registered. A VAT registered party can claim back the VAT on solicitors fees from HMRC and therefore cannot also recover the cost back between parties. A Claimant in personal injury litigation is always able to recover VAT because he or she is not VAT registered in his/her personal capacity.

The Supreme Court Costs Office does not normally allow local travelling expenses which it defines as travel within 10 miles of the solicitor’s office (PD 5.22 (3) . The costs of travel further afield can be recovered. We argue that travel should be at the professional business first class level, but more parsimonious cost judges only allow standard rate travel, which is the rate they are allowed at the moment for official business!
