Sandwiched Mom: Holiday Helpers
http://smartwomanlaw.blogspot.com/2009/12/holiday-helpers.html
December 1, 2009. The holidays also may be a time when families face the difficult decisions about finding care for their older relative. Here are some of the changes that may indicate your loved one needs some extra help. Bad personal hygiene or significant negative changes in personal hygiene. Unusually loud or quiet, paranoid, agitated behavior. Unusually cluttered, dirty or messy home. Local friends and relatives are expressing concerns about changed behavior. Last, but certainly not least, your love...

January 20, 2010. I admit it, I have a paper problem. I feel like I am continually buried in the stuff, especially paper, and powerless to let go. But all that is changing. I spent a fair number of hours over the Christmas holiday (now you know what I do on vacation) digging out and tossing paper both at home and at my office. The result? So how do you decide what to keep and what to toss? And how long should you keep the stuff you keep? Toss After One Year. Cell phone bills (personal)*. Loans (that you'...

October 8, 2009. It's A Wild World Out There. What do you do when when someone whose name is similar to yours opens an account in your name? This was the situation presented to me by a client recently. He was wondering what the implications of this were and how to prevent it in the future. He didn't want to take any action against his son, but he did want to protect himself from inadvertently being taken advantage of. Fraud alerts come in 2 forms: an initial alert. Good for 90 days, and an extended alert.

October 29, 2009. Creating A Legacy. . . It's Not About The Money. I spent last weekend in LA at the Personal Family Lawyer. Mastermind. This is an event where we gather and learn more about how to really serve our clients with passion. I had some breakthroughs in my thinking, and left excited, motivated and with a list of things to work on. September 3, 2009. What Doctors Won't Tell You. Well, OK they will tell you but no one else because they are shackled by a law called HIPAA. Have taken a hard line – if it’s not you ,they won’t release the information. So what kind of information are we talking about? Ever have a problem with an insurance claim or medical charge? Have trouble deciphering your EOB (explanation of benefits)? Want to talk with your spouse’s doctor or your aging parent's doctor? That’s all protected medical information.

September 30, 2009. Is This Someone You Know? The son called me seeking advice on how to help mom. He was being told by the doctors that he needed a power of attorney to take mom out of the hospital. But here’s the catch—mom may or may not have the mental capacity to execute a power of attorney! Why go to the extra time and expense when form documents might do? I realize that estate planning is not high on many people’s list of things to do, as evidenced by research that shows 65% of Americans do n...

October 19, 2009. What We Have Here Is A Failure To Communicate. This past week reinforced just how important communication is. I was chatting with a client when she asked how the kids were and what they were going to be for Halloween. I told her my younger son was going to be a Transformer (Optimus Prime for those in the know) and she said "I have a transformer story for you! Later that same week I had the pleasure of giving a talk about Advance Healthcare Directives to a group of nursing home administr...

October 22, 2009. Is Your Trust A Paperweight? This scenario plays out countless times each year, but if this is all you do, you and your family may be in for a rude shock! The “set it and forget it” mindset can create a false security leaving you thinking you have taken care of everything when in reality you haven't. Why? Because life is all about change. You might ask, if my plan’s not up to date how bad could it be? Let’s look at a few simple questions. What if your assets are not owned the right way?
