Probably the most satisfactory form of Alternative Dispute Resolution is Mediation, a consensual process by which the parties negotiate to resolve their dispute, aided by a third party mediator who helps facilitate the discussions but who has no authority to coerce an agreement. Matters discussed during Mediation are confidential, thus avoiding the risk of sensitive information being divulged in public court proceedings.
