Invention Prototypes - Reduction to Practice
http://www.patent.institute/invention-prototypes---reduction-to-practice.html
For idea #3, letâ s develop a working prototype. First, we order a few samples of the paper-laminated foil from sources discovered during the brainstorming phaseâ we do this a couple of times from different sources until we find the right thickness that will provide the RFID blocking features we are looking for, but is still thin enough to not be discomfiting or awkward when inserted into a wallet. Â Continuing on, we download the desired royalty-free graphic and create a â not RFIDâ symbol to indicate t...

Testing the Invention
http://www.patent.institute/testing-the-invention.html
Does the invention work? Remember that standard we found during the work-shopping phase? It is a very specific standard required by law and requires that the chinstrap and buckle do not come undone when subjected to a certain force. How do you find out if your product needs to be tested in accordance with existing standards and regulations? Likewise, if an invention is kid related, thereâ s almost certainly a testing regulation. In addition to product testing there is a legal obligation to â warn and ins...

Provisional Patent Application (PPA)
http://www.patent.institute/provisional-patent-application--ppa-.html
You donâ t have to file a PPA, but if you can find a law firm that will prepare and file a PPA on your behalf, and will credit the PPA fees towards their fee for preparing and filing the follow-up utility patent application, then it may be to your benefit to have the attorney prepare and file a PPA. You can file a PPA yourself. You donâ t need an attorney to do it for youâ which is not recommended of course. But you can do it. You often hear this â patent pendingâ phrase on ABCâ s Shark Tank program....

Example Opinions
http://www.patent.institute/example-opinions.html
For instructional purposes, letâ s say we do find an enforceable patent. The first thing we do is look at the claims section, located typically towards the back of the patent. Recall that a patent is a right to exclude others from making, using, selling or offering for sale the patented invention defined by the claims. Looking at the claims of the hypothetically allowed patent, we see that not only are each of the claims one sentence long, they are each a certain structure. It always begins with a pr...

What should you bring with you to the first meeting with the patent attorney? Â Everythingâ is the standard answer; but, usually, you donâ t need to bring a prototype. Drawings or sketches are generally sufficient for the first meeting. You should also be prepared to discuss the pros and cons of your invention in regards to your research. This will help facilitate a much more productive and cost-effective discussion with the attorney. Often, during the initial visit, inventors will ask the attorney their...
