The proposal imposes a new reasonable classification requirement on contribution and benefit formulas for highly compensated employees in cross-tested retirement plans that will make it significantly harder for plans, especially small business plans, to pass the general nondiscrimination test under Section 401(a)(4) of the Internal Revenue Code. We need to tell the folks in Washington to Save My Plan!
