近年來土地徵收與土地掠奪成為台灣社會嚴重關切的課題，許多激烈抗爭及社會運動都與其有關，這是因為政府非常輕易的進行土地徵收與土地掠奪，數量頗為驚人，惟其剝奪的並非僅是土地被徵收人及被掠奪人之財產權，往往亦涉及其生存權、工作權、及基本人權，而這些權利與〈憲法〉第15條，及〈經濟社會文化權利國際公約〉第11條第1項、〈第4號一般性意見〉、及〈第7號一般性意見〉嚴重牴觸。本文之主要目的，乃是要指出現行台灣土地徵收與土地掠奪嚴重違背了上述規定，對人權造成了非常嚴重之侵害，也因此導致了許多家庭被強制驅逐的悲慘命運。土地徵收（Land Expropriation, Land Taking, or Eminent Domain）係國家因公共事業之需要，對人民受憲法保障之財產權，經由法定程序予以剝奪之謂（司法院釋字第425號）（註1）。人民之財產權、生存權及工作權既為憲法保障之基本人權（憲法第15條），則國家因公用或因其他公益目的之必要&...土地徵收的首要要件即是它必須符合促進公共利益的要求。所謂的公共利益是個抽象的詞彙、不確定法律概念，它必須經由非常嚴謹的行政程序來予以體...12296;司法院大法官釋字第409...
