最高裁判所は、東京高等裁判所が平成25年11月1日に言い渡した審決取消等請求事件の判決に対し、公正取引委員会及びJASRAC 一般社団法人日本音楽著作権協会 が上告受理申立てを行っていた事件 以下、 本件 といいます。 最高裁判所判決全文 http:/ www.courts.go.jp/app/files/hanrei jp/064/085064 hanrei.pdf. その上で、最高裁判所は、JASRACがほとんど全ての放送事業者との間で包括徴収による利用許諾契約を締結して使用料を徴収する行為 以下、 本件行為 といいます。 が 他の事業者の事業活動を排除 する行為に該当するか否かは、 自らの市場支配力の形成、維持ないし強化という観点からみて正常な競争手段の範囲を逸脱するような人為性を有するものであり、他の管理事業者の本件市場への参入を著しく困難にするなどの効果を有するものといえるか否か によるべきとの先例の基準を示した上、以下のような判断をしました。

ニュース 信書 と 非信書 について. 当該取り扱いの議論は、郵便法 昭和２２年１２月１２日法律第１６５号 及び民間業者による信書の送達に関する法律 平成１４年法律第９９号、以下 信書便法 といいます において 特定の受取人. である 信書 は、郵便又は信書便法の許可を受けた民間事業者でなければ送達することができないものとされており、これに違反していわゆるメール便に 信書 を同封して送ると、事業者のみならず利用者も３年以下の懲役又は３００万円以下の罰金に問われることがあるという法規制があることにあります。 当該法規制の是非はさておくとしまして、 信書 の定義は上記のとおり特定の受取人に向けた手紙や通知の類を広く含めるものとされており、いわゆるダイレクトメールであっても文書自体に受取人が記載されている文書の場合は 信書 に該当するものと解されるなど、これまで事実上メール便で送られている書面の中にも 信書 に該当し得るものと解され、実質的には郵便法違反と考えられるものが多く存在するものと推測されます。
