In a landmark decision dated October 30, 2012, the Swiss Supreme Court ruled in favor of the client noting that fees collected by banks from their asset managers and other financial intermediaries are property of the customer unless a valid waiver has been signed. Historically these fees (called Retrocessions, Trailing Fees or Kickbacks) were kept by the banks or other financial institutions and recorded as revenues.
