While it is unclear (at the time of this writing) when small companies will truly have to deal with all the non-discrimination rules, my advice to all my clients is that they should proceed as if the rules are already in place. This is the most prudent approach from a risk-management perspective. So what does this mean for you? Waiving waiting periods or other eligibility requirements for new-hire HCEs.
