家 的解構與重構 從法國、德國、比利時與歐盟層次新近法制談 異性婚姻 外之其他共同生活關係. 數人加功於一個犯罪行為事實之上，其參與關係究竟皆為正犯 抑或是有正犯也有共犯 其區隔判斷的標準，到底在那裡 這是參與區分制參與理論所存在的根本問題。 對於共同正犯類型的判斷，從大法官釋字第一 九號解釋之後，向來都有 共謀共同正犯 與 實行共同正犯 之分，在意義上，似乎將共同正犯的結構，區隔成 預備階段 與 實行階段。 然而，共同正犯的形成是否可能發生在單純 共謀 的階段，倘若欠缺實行的關係，是否仍舊可能發生共同正犯的問題 這是值得思考的問題。 為釐清共同正犯判斷的問題，刑法修正時確實也作相當程度的檢討，但最終修法時，卻不是作概念上的澄清，而僅是將法律文字從 實施 改為 實行 ，是否這樣的修法，就能夠釐清共同正犯形成的判斷問題 就能夠解決對於 共謀共同正犯 與 實行共同正犯 區分的迷思 還是必須從概念的根本性問題著手，方得以得出判斷共同正犯的標準，進而確認形成共同正犯的條件。 本文嘗試從共同正犯形成的結構關係著手，分析其刑成關係與條件，並對於 共謀 與 實行 共同正犯的形成，重新作一個基本的詮釋。
