Canadian citizens are entitled to work authorizations in over 60 professional occupations. The work authorizations are valid for up to three years and can be renewed indefinitely under current regulations. The employer can be either U.S. based or a Canadian company that requires an employee to work temporarily in the United States. A listing of NAFTA professional categories is found at the U.S. Code of Federal Regulations, 8 CFR 214.6.

The free trade agreement provides special rights for Canadians to enter the United States in the pursuit of business activities. A key point for Canadian negotiators in the Canada-U.S. Free Trade Agreement was the “after-sales service” provision. It allows “installers, repair . maintenance personnel and supervisors” to enter the United States to carry out warranty or service activities on products manufactured outside the United States.

In some cases a business person will have a criminal record that prevents them from entering the United States. Unfortunately, a pardon from the Canadian government is not recognized by the United States. Our office will prepare the required application to obtain a waiver from U.S. authorities. Under current processing procedures applications are filed with local U.S. immigration authorities and sent to the Administrative Review Office in Herndon, Virginia for adjudication.

Canadian companies, and individuals, are eligible for E-1 status with the U.S. State Department based upon the level of trade with the United States. Trade can consist of goods or services. Eligibility is established if at least 50% of all international trade is with the United States.
